EODYNE SYSTEMS, SL (hereinafter referred to as “the owner”), as the data controller, makes this LEGAL NOTICE available to users of RGS+ to regulate the use of RGS+ and to comply with the obligations set forth in Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE), as well as to inform users about the conditions of use of RGS+.
Any person who accesses this website assumes the role of user (hereinafter “the user”), and implies full and unreserved acceptance of each and every provision included in this Legal Notice, as well as any other applicable legal provisions.
EODYNE SYSTEMS, SL reserves the right to review and modify these terms of use at any time, including for legal, technical, or service-related reasons.

TERMS AND CONDITIONS OF USE

These terms govern access to RGS+, as well as the content made available to users of RGS+, both via the web browser version and the mobile app version. They apply without prejudice to any specific conditions that the user may accept.
RGS+ is an application that offers personalized cognitive and motor rehabilitation exercises. To access the app, users must have a registered account, which may be created by an authorized rehabilitation center or directly by the user through the website www.eodyne.com. Once logged into the app, users can perform exercises, track their progress, and, if applicable, manage their subscription.
The user guarantees the authenticity of the information provided. It is the user’s responsibility to keep their information up to date and reflective of their current situation. The user is solely responsible for any false or inaccurate information provided and for any resulting harm caused to the provider or third parties.

ACCESS CONDITIONS TO RGS+

Access to RGS+ is only possible through the mobile application, available for download at:

  • Google Play Store
  • Apple App Store

To use RGS+, users must have a registered account, either created by the user via www.eodyne.com or provided by an authorized rehabilitation center.

To access RGS+, users must:

  • Be 18 years of age or older.
  • Be registered and identified using valid credentials.

There are two ways to obtain RGS+ access credentials:

  • If the user is a patient of a rehabilitation center that uses RGS+, the center will provide the credentials.
  • If the user is not linked to any center, they may register individually via the form available on www.eodyne.com by entering the required information.

Access credentials —consisting of a username and a personal password— allow users to access both the RGS+ app and the private area of the website www.eodyne.com.

Through the RGS+ app, users can perform their rehabilitation exercises. Through the website, users can log in to manage their subscription, view purchase history, or check the remaining days of their active access to RGS+.

ACCESS LOGGING

In accordance with Royal Decree 311/2022 of May 2, which regulates the National Security Framework, and in full compliance with the rights to honor, personal and family privacy, and self-image, as well as the applicable data protection regulations, user activity will be logged. Only the strictly necessary information will be retained to monitor, analyze, investigate, and document unauthorized or improper activities, enabling the identification of the individual responsible.

TERMS OF USE

The use of RGS+ implies the acquisition of user status and acceptance of the following conditions:

Use of RGS+ must comply with the law, this legal notice, and any applicable specific conditions. In the event of non-compliance by the user, the owner reserves the right to take legal action and restrict access to RGS+.

“Content” is understood to include texts, designs, indexes, formats, photos, videos, audio, images, reports, opinions, and any information capable of being reproduced, distributed, or transformed.

Users are solely responsible for uploading any documents, texts, images, videos, or information. By uploading content, users waive any proprietary rights they may hold over it. Additionally, uploading content that violates intellectual or industrial property rights without authorization is always the responsibility of the uploader.

EODYNE SYSTEMS, SL reserves the right to report and cooperate with the relevant authorities if any legal violations are detected, and may delete content from RGS+ that gives rise to such violations.

EODYNE SYSTEMS, SL makes RGS+ available to users and will only be liable for diligence required by law. It will not be liable for any direct or indirect consequences of misuse or fraudulent/illegal use of RGS+ by users.

EODYNE SYSTEMS, SL may limit the storage, publication, or sharing of content considered defamatory, racist, sexist, xenophobic, discriminatory, pornographic, violent, immoral, illegal, or unrelated to the purpose of RGS+.

EODYNE SYSTEMS, SL may suspend or cancel a user’s access in the event of a breach of these terms, without compensation.

Users are required to make reasonable use of RGS+ according to its intended purpose and are solely responsible for the content they share. Links from defamatory, pornographic, racist, xenophobic, or misleading websites are strictly prohibited.

Users are solely responsible for safeguarding their login credentials and for any damages caused to EODYNE SYSTEMS, SL or third parties due to unauthorized use.

Users may report any content, comments, or users that violate these terms. If such reports are verified, EODYNE SYSTEMS, SL may take action in accordance with the above provisions.

PERSONAL DATA PROTECTION

The owner ensures compliance with all data protection obligations and the implementation of required security measures. For more information, please refer to the Privacy Policy.

COOKIES

The owner’s website may use cookies (small data files sent from the server to the user’s device) to carry out essential functions for the proper functioning and visualization of the site. INTELLECTUAL AND INDUSTRIAL PROPERTY

EODYNE SYSTEMS, SL holds all industrial and intellectual property rights related to RGS+. Its name and all distinctive signs shown in RGS+ are the exclusive property of EODYNE SYSTEMS, SL and may not be used by third parties without prior express authorization.

Neither RGS+ nor its content may be copied, reproduced, distributed, or used to create derivative works without the explicit written consent of EODYNE SYSTEMS, SL.

APPLICABLE LAW AND JURISDICTION

RGS+ is subject to the provisions of Spanish law. Any disputes arising from the use of RGS+ will be submitted to the courts of Barcelona, Spain.
